Meshki Boutique takes active steps to protect its rights in its designs and strictly enforces these rights pursuant to the applicable laws.

Making electronic, or other, copies of products displayed on this Website with the intent of reproducing them in whole or in part is strictly prohibited.

Applicable Law

By accessing the Website you accept that any disputes about this site or its Content are to be determined by the courts having jurisdiction in New South Wales, Australia, according to the laws in force in that State and subject to the application of any principle of conflict of laws inconsistent with this requirement.

As this site can be accessed throughout Australia and overseas, Meshki Boutique does not represent that the Content complies with the laws of any country outside Australia. If you access this site from outside Australia, you do so at your own risk and responsibility, and are responsible for making sure you comply with all applicable laws in the place you are located.

Purchases and Payment

Customers must provide Meshki Boutique with complete and accurate details when making purchases. Meshki Boutique is not liable if we are given an incorrect delivery address at the time of purchase. Any additional expenses in correcting the order are the responsibility of the customer.

All prices quoted are in Australian dollars (AUD) and include GST. Costs related to international orders are calculated using an integrated currency converter. Meshki Boutique is not responsible for varying currency conversion rates charged by customers’ banks.

Payment is processed through PayPal. Upon checkout, customers will be redirected to the PayPal website where they can select their payment method. However, it is not necessary for customers to have a PayPal account to shop with Meshki Boutique.

Afterpay service is available on Australian orders only. At checkout, customers will be redirected to the Afterpay website to complete the transaction. To be eligible for Afterpay, customers must have an existing Australian Visa or Mastercard debit/credit card, over 18 years of age, live in Australia. Customers will receive an invoice confirming the order once Meshki Boutique receives payment. Some orders may be subject to fraud checks by the Meshki Boutique staff, this means you may be required to provide additional identification to verify your transaction.

Discount Codes, Sales & Promotions

All discount codes are in AUD. Discount codes cannot be used in conjunction with any other offer. Please note, discount codes cannot be used to purchase gift cards.

Fraud

Meshki Boutique takes every measure against credit card fraud. If we suspect that a customer’s order may be fraudulent, we will contact the customer to confirm certain details. If the customer refuses to respond with the required information within 7 days, we reserve the right to cancel the order.

Cancellation

Meshki Boutique reserves the right to cancel any order if we are unable to provide the requested products. Customers will be immediately contacted in these cases.

Meshki Boutique is not liable to compensate for any loss, expense or inconvenience customers may face as a result of cancellation.

Right of Withdrawal (UK and EU Customers)

(a) Application

This clause applies only to customers who are consumers (that is, purchasing other than in the course of a trade, business, craft or profession) and who have ordered products from the Website for delivery to an address in the United Kingdom or a Member State of the European Union. 

(b) Right to Withdraw

Subject to clause 12(e), a customer described in clause 12(a) has the right to withdraw from their contract with Meshki Boutique within 14 days, without giving any reason and without incurring any liability other than as set out in this clause.

The withdrawal period expires 14 days from the day on which the customer (or a third party nominated by the customer, other than the carrier) takes physical possession of the products. Where an order is delivered in separate parcels or instalments, the withdrawal period runs from the day the customer receives the last item.

(c) Exercising the Right to Withdraw

To withdraw, the customer must inform Meshki Boutique of their decision by way of a clear statement before the withdrawal period expires. This can be done by:

• emailing our customer service team at [email protected]; or

• withdrawing the order directly via the Loop Returns portal at https://return.meshki.co.uk/#/; or

• completing the Model Withdrawal Form set out below and emailing it to [email protected] (the same address as above); or

• any other clear, unambiguous statement of the customer's decision to withdraw.

It is sufficient for the customer to send their notice of withdrawal before the 14-day period expires.

Meshki Boutique will provide the customer with an acknowledgement of receipt of their withdrawal notice on a durable medium (such as email) without undue delay.

(d) Returning Goods and Refunds

Following a valid withdrawal, the customer must send back the goods without undue delay and in any event within 14 days of telling Meshki Boutique they wish to withdraw. The direct cost of returning goods is borne by the customer, unless Meshki Boutique has agreed to cover that cost or failed to inform the customer that they must bear it.

Meshki Boutique will reimburse all payments received from the customer, including standard delivery charges (but excluding any extra cost where the customer chose a delivery method other than the least expensive standard delivery Meshki Boutique offers), without undue delay and in any event within 14 days of:

(i) receiving the returned goods; or (ii) the customer providing evidence that the goods have been sent back,

whichever is earlier. Reimbursement will be made using the same payment method used for the original purchase, unless otherwise agreed with the customer, and no fee will be charged for the reimbursement.

Meshki Boutique may withhold reimbursement until the goods have been received back, or the customer has supplied evidence of having sent them back, whichever is earlier.

Customers are liable for any diminished value of goods resulting from handling beyond what is necessary to establish their nature, characteristics and how they work.

(e) Exclusions

The right of withdrawal does not apply to, among other things:

(i) goods made to the customer's specifications or clearly personalised; (ii) sealed goods which are not suitable for return for health protection or hygiene reasons and which have been unsealed after delivery (including, without limitation, swimwear, underwear and earrings where a hygiene seal has been removed); and (iii) any other goods or services excluded from the right of withdrawal under applicable law in the customer's country.

(f) General

This clause reflects Meshki Boutique's obligations to consumers in the United Kingdom and European Union under applicable consumer protection law, including the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (UK) and Directive 2011/83/EU on consumer rights, as amended. Nothing in this clause limits any right of a customer that cannot lawfully be excluded. It does not replace, and should be read alongside, Meshki Boutique's Returns Policy, which sets out the practical process for returning items.
